Lake Buyer FAQ

Straight answers to the most common questions about buying and selling in Western New York.

The Details

What you need to know before you sign.

There is a significant difference between buying a suburban home and buying a waterfront property or ski chalet. From navigating local zoning and deeded lake rights to understanding seasonal inventory spikes, these are the logistical answers buyers ask me most.

Yes. They aren't making any more lakefront. Chautauqua County is uniquely positioned within a 90-minute drive from major feeder markets like Buffalo, Pittsburgh, Cleveland, and Erie. As waterfront land continues to be developed or purchased for conservation, the remaining inventory holds exceptional value. Buying a lake home here is a lifestyle investment that traditionally appreciates steadily over a 3-5 year horizon.

Lakefront means the property directly abuts the water—your lawn runs to the shoreline and you have a dock or the right to install one. Lake access means you have a right to reach the lake, but the property itself doesn't front the water. This might be a shared path, a deeded right-of-way, or a community beach. Lakefront properties carry a significant premium because you are paying for actual shoreline control, not just the right to visit it.

There are no "bad" areas, but location dictates utility. The North Basin (Mayville) is the deepest part of the lake, making it ideal for sailboats and deep-draft vessels. The South Basin (Lakewood) is shallower but offers a year-round village community. The Eastern shore (Bemus Point Gold Coast) commands high prices because it faces west, giving you direct sunset views. I guide my buyers based on what type of boat they own and what lifestyle they want.

Yes, short-term rentals are a massive part of the local economy, heavily driven by the 9-week Chautauqua Institution summer season and the winter ski season. However, you must navigate local zoning laws. For example, the Town of Ellery has strict rules prohibiting weekly rentals in certain R-1 districts without specific permits. I help buyers verify local rental zoning before they make an offer on an investment property.

Yes. New York is an attorney-close state. You will need a real estate attorney to handle the title work, review the contracts, and facilitate the closing. I maintain a network of reasonably priced, highly experienced local real estate attorneys who specifically understand the complexities of waterfront deeds and lake rights.

Inventory traditionally spikes in the spring and early summer as sellers prepare for the prime season. However, buying in the winter means you face significantly less competition from other buyers. If you view a lakefront property in the winter and love it, you will absolutely love it in July. Prices do not typically drop just because it is snowing.

This is a critical inspection point. Many older lakefront properties utilize aging septic systems. Chautauqua County enforces strict regulations regarding setbacks and capacities near the water. Replacing a failing septic system on a restrictive waterfront lot can be a major expense. You should always demand a thorough septic inspection and verify when the system was last updated to current county code.

Holiday Valley is a public ski resort, meaning the chalets and condos surrounding it have unrestricted public access and massive short-term rental demand. HoliMont is North America's largest private ski club. Properties situated along HoliMont trails offer intense privacy and exclusive weekend lift access, leaning toward buyers who want a prestigious, restricted mountain retreat.
